Returns & Refunds for Damaged and Defective
Quality is paramount and returned Merchandise on the basis that it is damaged or defective will be inspected. If there is any damage to the Merchandise as a result of a manufacturing defect or deviation from factory specifications, we shall exchange the damaged or defective Merchandise with a new Merchandise or provide you with a full refund.
If the defect in the Merchandise was caused by factors other than manufacturing defects within our control (e.g., during the course of delivery), we will not provide you with a refund but we will exchange the defective Merchandise with a new Merchandise.
There shall not be any exchange or refunds for Merchandise:
- Damaged by abuse or negligence, exposure to chemicals, caustic substances, open flame, high heat, sharp object, usage not within manufacturer’s or supplier’s guidelines
- Damaged by misuse or activities other than the intended purpose
Warranties and Liability
To the maximum extent permitted by law, Global Trader Marketing excludes all conditions, warranties and guarantees (whether express or implied by or arising under statute, common law, equity, trade custom or usage or otherwise), and makes no representations, relating to the products ordered by you, including warranties or guarantees of acceptable quality, merchantability and fitness for purpose. Nothing in these Terms excludes limits or modifies any conditions, warranties or guarantees implied by or arising under statute which cannot lawfully be excluded.
Where conditions, warranties or guarantees implied by or otherwise arising under law cannot be lawfully excluded, then to the extent permitted by law, Global Trader Marketing liability for a breach of any such condition, warranty or guarantee is limited, at the absolute option of Global Trader Marketing Bonsey Jaden to the exchange of the products or the supply of equivalent products or the cost of replacing or of acquiring equivalent products.
Otherwise, to the maximum extent permitted by law, of Global Trader Marketing, and/or their respective officers, employees, agents and representatives will not be liable for any loss or damage (including, but not limited to, any loss of profit, loss of sales, loss of market, loss of goodwill or reputation, third party claims, incidental or special damages or indirect or consequential loss or damage of any kind) to any person or entity, however caused (whether by negligence or otherwise), which may arise directly or indirectly from or in connection with these Terms, this website or any orders you place via this website.
Retention of title
The delivered Merchandise will remain the property of Global Trader Marketing (or as otherwise specified in the relevant agreement between TS Gratenice Distribution Sdn Bhd and its supplier until you have paid all amounts owing under any agreement to us via PayPalthe payment platform, in full, including the payment of costs, even of earlier or later deliveries or partial deliveries. You undertake not to sell, dispose of or encumber Merchandise before ownership thereof has passed to you.
These Terms are governed by the laws of Malaysia, and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Malaysia.
